Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Ink Studio mobile application or website (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not use the Service. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Eligibility

You must be at least 18 years of age to use Ink Studio. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Account Registration

To access certain features, you may need to create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your account information.
• Keep your password confidential and not share it with others.
• Accept responsibility for all activities that occur under your account.
• Notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.

4. Use of the Service

Ink Studio grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes. You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Generate content that is offensive, hateful, discriminatory, violent, sexually explicit, or infringes on the rights of others.
• Attempt to reverse-engineer, decompile, or disassemble any part of the Service or its underlying AI models.
• Use automated tools, bots, or scrapers to access the Service without our written permission.
• Interfere with or disrupt the Service, servers, or networks connected to the Service.
• Resell, redistribute, or sublicense the Service or any AI-generated designs without authorization.

5. AI-Generated Content and Intellectual Property

Ink Studio uses artificial intelligence to generate tattoo designs based on your inputs. Regarding the content generated:

• Your inputs: You retain ownership of the text prompts, reference images, and other materials you provide to the Service.
• Generated designs: Subject to your active subscription or purchase, you are granted a personal-use license to the AI-generated tattoo designs. You may use them as tattoo references, personal artwork, or share them with tattoo artists for the purpose of getting tattooed.
• Restrictions: You may not claim AI-generated designs as entirely your own original artwork for commercial resale, mass merchandise production, or use in competing AI services without our explicit written consent.
• No guarantees: AI-generated designs may occasionally resemble existing artwork. We do not guarantee that generated designs are free from similarity to third-party works.

6. Subscriptions and Payments

Ink Studio may offer free and paid subscription plans. If you choose a paid plan:

• Payments are processed through the Apple App Store or Google Play Store and are subject to their respective terms and policies.
• Subscriptions automatically renew at the end of each billing cycle unless canceled at least 24 hours before the renewal date.
• You can manage or cancel your subscription through your device settings or the respective app store.
• Refunds are handled in accordance with the policies of the Apple App Store or Google Play Store. We do not process refunds directly.
• We reserve the right to change pricing with reasonable notice. Price changes will not apply to your current billing cycle.

7. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. We disclaim all warranties including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that:

• The Service will be uninterrupted, error-free, or secure.
• AI-generated designs will meet your specific expectations or requirements.
• The results obtained from the Service will be accurate or reliable.
• Any tattoo design generated is safe to use on skin or that the final tattooed result will match the digital design.

Tattoo-specific disclaimer: Ink Studio is a design tool only. We are not responsible for the outcome of any tattoo applied to your body based on designs created through our Service. Always consult with a professional, licensed tattoo artist before getting tattooed.

8. Limitation of Liability

To the maximum extent permitted by law, Ink Studio and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising from your use of or inability to use the Service. Our total liability for any claim arising out of or relating to these Terms shall not exceed the amount paid by you, if any, to access the Service during the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Ink Studio, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Service, violation of these Terms, or infringement of any third-party rights.

10. Termination

We may terminate or suspend your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will cease immediately. Sections of these Terms that by their nature should survive termination shall continue to apply, including intellectual property provisions, disclaimers, limitation of liability, and indemnification.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Ink Studio is incorporated, without regard to conflict of law principles. Any disputes arising under these Terms shall first be attempted to be resolved through good-faith negotiation. If a resolution cannot be reached, disputes will be submitted to binding arbitration in accordance with the rules of the applicable arbitration association.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the app or by email at least 30 days before they take effect. Your continued use of the Service after the effective date constitutes your acceptance of the revised Terms. If you do not agree with the changes, you must stop using the Service and delete your account.
